By downloading, installing, or using this mobile application ("the Licensed Application"), you agree to be bound by these Terms and Conditions ("the Agreement"). This Agreement is established between you ("the End User") and the developer or entity listed as the seller or creator of the Application on the corresponding app store ("the Provider"), and not with Apple Inc. or Google LLC.
The Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any device that you own or control, solely for personal and non-commercial purposes. The terms of this license govern any updates provided by the Provider that replace or supplement the original Application, unless such update is accompanied by a separate license.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE PROVIDER DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE APPLICATION WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION THEREOF WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION. THE TOTAL LIABILITY OF THE PROVIDER TO YOU SHALL NOT EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID FOR THE APPLICATION.
If the Licensed Application offers auto-renewing subscription services:
Billing: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. The account will be charged for renewal within 24-hours prior to the end of the current period at the cost of the selected plan.
Management: You may manage your subscriptions and turn off auto-renewal by going to your Account Settings in the respective app store after purchase.
Refund Policy: Refunds are managed directly through the app store policies (Apple or Google) and not by the Provider directly.
The Licensed Application may integrate third-party services for infrastructure, advertising, and analytics functionalities. You acknowledge that the Application may use, among others:
Data processing through these services is subject to the Provider's Privacy Policy, available for review in the store listing of the Licensed Application.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
This Agreement shall be governed by the laws of the jurisdiction where the Provider has its fiscal domicile, excluding its conflicts of law rules.
